Results Oriented Streamlined Approaches (ROSA) – Corrective Action Streamlined Consent Orders

The purpose of the ROSA training program is to provide information regarding results-oriented streamlined approaches to implementing a RCRA corrective action program at a facility. The goal of these approaches is to bring about more efficient and accelerated investigation and remediation efforts at facilities undergoing RCRA corrective action.

Corrective action streamlined orders have the advantages of being briefer, having a shorter time frame for issuance and implementation, and promote achieving Environmental Indicators. They also focus on identifying and achieving acceptable cleanup objectives rather than on process and formal review and comment. Streamlined consent orders offer the same quality investigation and cleanup requirements as a more traditional approach, but limit formal review and approval, and provide increased flexibility and reduced costs in order to expedite corrective action.

This presentation will review the applicability authorities under which streamlined consent orders may be issued, discuss good and poor candidates for streamlined orders and the factors that affect that decision. It then highlights opportunities for streamlining orders through the use of streamlined findings of fact, generic scopes of work, consolidated penalties, and streamlined administrative process. Technical components also are addressed, along with tips for expediting the RFI, CMS, and interim measures. Examples also are provided.
